General Terms and Conditions (GTC)
The owner of the property concludes rental agreements with his guests. Under the brand name “Mike’s apartments GmbH”, the apartments at Dachauer Str. 310 in 80993 Munich are made available as serviced apartments for the sole use of the respective guest for the duration of the agreed rental period.
§ 1 RENTAL OBJECT
The serviced apartments each have a separate kitchen, shower room and balcony for the sole use of the respective guest. In the basement of the building there is a laundry and drying room with a washing machine and dryer for the shared use of all guests. Car parking spaces for communal use are available to tenants. Each apartment is rented furnished. There is no entitlement to a specific serviced apartment at “Mike’s apartments GmbH”. The tenant is not entitled to claim damages.
§ 2 MOVING INTO THE APARTMENT
The rented rooms can be occupied from 3:00 p.m. on the respective day at the beginning of the tenancy. The check-in information will be sent on the day of moving in. The tenant will receive a code for the entrance area and the respective apartment door.
§ 3 USE OF THE APARTMENT
The landlord shall provide the Serviced Apartment to the tenant for temporary use. The rented property is only intended for use as temporary residential accommodation for the respective tenant. Any commercial use must be agreed separately in writing with the landlord and must be notified prior to moving in. The tenant may use the existing furniture and furnishings within the scope of the rental agreement. The tenant is obliged to treat the furniture with care. The tenant may not remove the rented furniture from the apartment. Technical equipment may only be used in accordance with the manufacturer’s instructions in the operating manual. The tenant is prohibited from smoking in the rented rooms. Animals may not be kept in the rented rooms.
§ 4 RENTAL PERIOD
The beginning and end of the rental relationship and the duration of the rental period shall be determined by agreement. The rental period may be extended if the booking situation permits. An extension of the tenancy shall only come into effect once confirmation has been received from the landlord. There is no entitlement to an extension. The agreed duration of the rental period can also be shortened by the tenant. In the event of a shortening of the agreed rental period by the tenant, “Mike’s apartments GmbH” may demand compensation for the lost rent.
§ 5 RENT
The amount of the rent is determined by “Mike’s apartments GmbH” and is transparently visible at the time of booking. The final cleaning is included in the rent. Also included in the rent are all usual operating and heating costs, the costs for public charges, garbage collection, water, sewage, gas, electricity, internet, stair cleaning, garden maintenance, internet, and television connections. These operating costs are not invoiced separately.
§ 6 DEPOSIT
“Mike’s apartments GmbH” may demand a security deposit from the tenant at the beginning of the tenancy to protect against damage and to secure all claims of the landlord arising from the tenancy. The amount is to be agreed. At the end of the rental period, the security deposit will be returned to the tenant without interest if there are no claims of the landlord against it.
§ 7 METHOD OF PAYMENT§ 7 ZAHLUNGSWEISE
The full amount must be paid to “Mike’s apartments GmbH” in advance before moving into the apartment. The timeliness of the payment does not depend on the date of dispatch, but on the date of receipt of the money. If the payment is not received on time, check-in to the apartment is not possible. If a deposit has been agreed, this must be paid by bank transfer to the landlord at the start of the rental period, before check-in.
§ 8 OBLIGATION OF THE TENANT TO MAINTAIN CLEANLINESS AND ORDER
The tenant must treat the house, the rented rooms including the furniture and the rooms, facilities and installations intended for communal use with care and attention, and ensure that the rented rooms are properly cleaned, ventilated, and heated. The tenant must observe the statutory rest periods and behave in such a way that the peace and quiet of the building is maintained.
§ 9 LIABILITY OF THE TENANT FOR DAMAGE TO THE RENTED PROPERTY
The tenant must notify the landlord immediately of any defects in the rented property that occur during the tenancy. The tenant is liable to the landlord for damage to the rented property and the furniture if he is culpable for causing such damage. The tenant is also liable for the loss of items within the apartment.
§ 10 ENTRX TO THE APARTMENT BY THE LANDLORD
The landlord may enter the apartments at normal times of a day and without making a separate appointment, provided that the landlord has a legitimate interest. This also applies to housekeeping in order to check or carry out minor maintenance on the rented property.
§ 11 MOVING OUT OF THE APARTMENT
The tenancy must be terminated by 10:00 a.m. on the day of departure. The apartments must be vacated and returned to the landlord in the condition in which they were found on moving in. Final cleaning is the responsibility of the landlord. Passing on the respective codes is strictly prohibited and will be prosecuted in the event of an offense.
§ 12 LAW AND PLACE OF JURISDICTION
The parties are subject to German law to the exclusion of international conflict of law’s provisions. The place of jurisdiction is the location of the rental property.
